Terms of Use

1. Who operates the website

The website is operated by Yelyzaveta Ivanova, a natural person based in the Czech Republic, under the brand name aaarcana ("aaarcana", "we", "us"). aaarcana is a brand name, not a registered company. Contact: hello@aaarcana.com.

2. Who the website is for

The website presents landing-page design and development services for businesses. It is not directed at consumers or at anyone under 18. If you use it on behalf of a company, you confirm you are authorised to accept these Terms for that company.

3. Nothing is sold through the website

The website is informational. No product or service can be ordered or paid for through it, and no contract for services is formed by using it, sending an enquiry or booking a call. Any paid work requires a separate written agreement signed by both parties. Pricing, packages and timelines shown on the website are general guidance, not a binding offer. If a signed agreement conflicts with these Terms, the agreement prevails.

4. Using the website

You may browse the website, share links to it and contact us through it. You agree not to:

• copy, scrape or harvest content or data from the website by automated means, including to train AI models, without our written permission;
• use the website for anything unlawful, misleading or harmful;
• attempt to gain unauthorised access to the website, its servers or connected systems, or interfere with its operation;
• upload or send malware, spam or content that infringes anyone's rights;
• impersonate any person or misrepresent your affiliation with any company.

We may restrict or end your access if you break these rules.

5. Intellectual property

The content of the website — text, design, layouts, code, graphics, video and case studies — is protected by copyright and belongs to Yelyzaveta Ivanova or the respective licensors. The aaarcana name and logo identify our services. You may view and share the website for personal or internal business reference. You may not reproduce, modify, sell or use its content to build a competing offer without our written permission.

Client names, logos and brand assets shown in our portfolio belong to their respective owners and appear with their permission. Their display does not imply endorsement beyond the work described.

6. Information you send us

When you submit a form, book a call or send us a brief, you confirm the information is accurate and that you have the right to share it. You allow us to use it to respond to you, prepare proposals and deliver any services you later agree to in writing.

Don't send confidential material until we have signed a confidentiality agreement. Until then, we cannot guarantee it will be treated as confidential. We process personal data as described in our Privacy Policy.

7. No guarantee of results

Case studies, conversion rates, revenue figures and other performance metrics on the website describe results from past projects. They depend on each client's product, traffic, offer and ad spend. They are not a promise or forecast of results you will achieve.

8. Third-party links and tools

The website may link to or embed third-party websites and tools, such as scheduling, analytics or video platforms. We do not control them and are not responsible for their content, availability or privacy practices. Your use of them is governed by their own terms.

9. Availability and disclaimer

The website is provided free of charge, "as is" and "as available". We do not guarantee that it will be uninterrupted, error-free or free of harmful components, or that its content is complete or current. We may change, suspend or remove any part of the website at any time without notice.

10. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential loss, lost profits, lost revenue or lost data arising from your use of, or inability to use, the website. Because the website is provided free of charge, our total liability for any claim relating to it is limited to EUR 100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for harm caused intentionally or through gross negligence, or for injury to a person's life or health. Nothing in these Terms affects any mandatory statutory rights you have.

11. Indemnity

If you use the website on behalf of a business, that business will compensate us for claims, losses and reasonable costs (including legal fees) arising from its breach of these Terms or its infringement of a third party's rights through the website.

Our Privacy Policy explains how we handle personal data. Our Cookie Policy explains which cookies we use and how you control them.

13. Changes to these Terms

We may update these Terms from time to time. The version number and "Last updated" date show the current version. Changes apply from the date they are published and do not apply to any matter that arose before that date. Previous versions are available on request at hello@aaarcana.com.

14. Termination

We may suspend or end your access to the website at any time if you breach these Terms. Sections 5, 7, 9, 10, 11 and 15 continue to apply after termination.

15. Governing law and disputes

These Terms and any dispute arising from them are governed by the laws of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code, excluding its conflict-of-law rules. Disputes will be decided by the court with jurisdiction under Czech law. Where mandatory law of your country gives you protection or a right to sue there, that protection remains.

Before going to court, please contact us at hello@aaarcana.com; we aim to resolve complaints within 30 days.

16. Notices

Legal notices to us must be sent to hello@aaarcana.com. We may send notices to you at the email address you gave us. A notice sent by email is treated as received on the next business day after sending, unless the sender gets a delivery failure message.

17. General

• Entire terms. These Terms, the Privacy Policy and the Cookie Policy are the full agreement on your use of the website.
• Severability. If any provision is found invalid, the rest remain in force, and the invalid provision is replaced by a valid one closest to its purpose.
• No waiver. If we don't enforce a right immediately, we don't give it up.
• Assignment. You may not transfer your rights under these Terms. We may transfer ours to a company we set up to run aaarcana or to a buyer of the business; we will publish the new operator's details on this page.
• Language. These Terms are written in English. If a translation is provided, the English version prevails.
